reserve the yachts in advance. The remaining balance must be paid 7 working days prior to the day of yacht departure. No cancellations or postponements can be made after payment, if a cancellation or postponement is needed, deposits will not be refunded.
2. Passengers on board cannot exceed the number written on the boarding pass,
otherwise, the captain reserves the right to refuse departing.
3.Yacht charter begins when the yacht arrives at the port of departure (including the
waiting time to park at the pier; yacht sailing time refers to the time needed for the round-trip listed on the invoice), the yacht has to be returned to the pier on time.
4.If the clients are still absent after two hours of the scheduled pick-up time, and there is
no update given by the contact person who represents the clients, the charter will be automatically terminated. If the clients suggest getting off the yacht earlier, no compensation will be made for the remaining time left.
5. Arrangements during bad weather conditions:
a. If there is a tropical cyclone warning signal no.3 or above or a black rainstorm
warning signal is issued by the Hong Kong Observatory within two hours prior to departure, for the sake of safety, the charter has to be postponed, but not cancelled. Under no other circumstances can the charter be postponed or cancelled, or else it would be an automatic abstention, thus all fees will not be refunded. (Regardless of the charter date/day, re-arrangements can only be granted within the same year on a weekday, no refunds can be given).
b. If there is a tropical cyclone warning signal no. 1 issued two hours prior to
departure, yachts will still be departing, please keep in touch with us for any updates.
c. If a tropical cyclone warning signal no. 3 or above or a black rainstorm warning signal is issued during the journey, according to the guideline from the Marine Department and for the sake of safety, the captain reserves the right
to return to the port earlier, but the remaining time will not be compensated or postponed.
6. Food and beverage invoices must be fully settled 7 working days prior to the charter
date, once an order has been confirmed, no changes or cancellations can be made. No refunds will be arranged. If there are any postponements or cancellations of the rental date, foods and beverages ordered through Air Yacht must be picked up at the departure area on the designated rental date, all payment must be paid as agreed.
7. If the client decides to cancel the trip halfway through, it would be regarded as
forfeiting the right to rent, all payments will not be refunded.
8. If there are any malfunctions of the yacht before departure and cannot be repaired in
time. The lessor will notify the client immediately of postponement or replacement for another similar yacht. If the client requests for refunds, Air Yacht will make refunds in full.
9. If there are any malfunctions during the trip, the captains will do their best to safely
send the passengers back to the piers. If malfunctions occur after half of the trip or the yachts have arrived at the destinations, no postponements can be made. A
postponement can only be arranged on a weekday. Or, a refund will be made in proportion to the balance rental time.
10. All yachts are under insurance's coverage according to the Hong Kong Maritime Law.
Passengers are responsible for all their personal belongings brought on board, if there are any damages or theft occurred on yachts, Air Yacht will not be held responsible, but will assist in the law enforcement and insurance claims.
11. Pets are not allowed on board unless with prior permission from the lessor. The
captain reserves the right to refuse to sail if there are any pets.
12. If the client needs to bring or rent electronic devices (such as speakers, DJ panels,
camera equipment etc.), please notify the lessor and make sure the permissions have been granted in advance.
13. No diving is allowed on the upper deck of the yacht, or else, all injuries/casualties will
be at the passengers’ own risk; Air Yacht does not bear any personal safety and legal responsibilities. Please note that third party insurance for vessels does not cover this kind of casualties.
14. The lessor does not provide daycare services for children, parents/guardians have the
responsibility to take care of children and ensure their safety.
15. If facilities on board are soiled: including sofas, decorations, carpets (vomiting,
defecation, throwing cakes, popping champagnes etc.), the lessor would charge HKD$5,000 as the cleaning fee.
16. The clients must be careful using any facilities on board, and follow the captains and
crews' guideline in accordance with the terms and conditions. If the participants caused any damages to the facilities on board, the clients are responsible for the compensation of such damages.
17. No drugs are allowed on board, if found, the police will be notified and all fees will
not be refunded.
18. The yacht photos on Airyacht’s website and documents are only for reference, if there
are any differences with the actual yachts, we will try our best to improve the qualities of these photos.
19. According to the Hong Kong Maritime Regulations, all yachts for charter must be
locally registered. They are only for entertainment purposes, all commercial ticketing and transportation are illegal. If there are any conflicts, Air Yacht reserves the final right.
Agreement for participating water sports
l take responsibility for and am in charge of the water activities this day, I have read and
understood such water activities (eg. wakeboarding/wakesurfing, banana boat, jetski, floating slide, swimming ring, trampoline, stand up paddling, kayaking, seabob, e-foil etc.) possess a certain risk. In order to avoid accidental injuries/casualties and property damages, I and all participants must follow all instructions and regulations of such activities.(Air Yacht recommends that the person in charge of chartering the yacht separately purchase water sports safety insurance).
Air Yacht Limited is a yacht sharing platform that aims to improve the safety of sailing fairly and reasonably, we play a role as an intermediary to coordinate and handle charter affairs between the lessors and the clients, and follow the laws of Hong Kong. In the event of a
major accident during the charter period, such as natural disasters or man-made disasters, the company will assist the two parties in the negotiation as a coordinator, but neither the company nor the yacht owners shall bear legal responsibility.
